How can i get one of my friends to buy me a new game since he broke the old one?

a let a trustworthy friend of mine borrow my black ops and one of his friends came over that i know and they were like playing and my friend said the game isnt working i asked him why he said he didnt know but i asked him if he knows something and he said that his friend "accidentally" kicked the xbox 360 and it made a grinding noise and now it gots a perfect ring around the outer circle and now it barely will play any maps on xbox live the only ones i can play is wmd,crysis,and sometimes grid.well and his parents don't give a damn so idk what to do and also i am not a violent person so don't say to beat the **** outta him.
